Eric Tucker’s attempt to get an injunction to prevent the Qalipu Mi’kmaq First Nation Band from conducting its election next week has been denied.

Tucker, an unsuccessful candidate for the chief position in the inaugural Qalipu election in 2012, has filed several applications in the Supreme Court of Newfoundland and Labrador in Corner Brook.
While the others are still to be dealt with by the courts, the application asking the court to order Qalipu to not go ahead with its election scheduled for Tuesday was dismissed by Justice Brian Furey when the matter was called Thursday.
Tucker’s other applications filed with the court involve asking the court to preserve Indigenous status cards for the more than 10,000 people who have been removed from Qalipu’s founding members list.
The band’s original founding members list in 2011 had more than 23,000 names on it. A supplemental agreement between the federal government, Qalipu and the band’s predecessor, the Federation of Newfoundland Indians, led to about 10,000 people being removed from the list and about 5,000 others added.
According to the Supreme Court docket, the next court date involving Tucker’s matters is Nov. 5.
