The case involving Shane Roderick White, one of two brothers accused of a Benoit’s Cove home invasion in March, will next be called in Supreme Court for arraignment.
White - whose matter is now separate from twin Shawn Robert White as the court ordered no contact between them - appeared in provincial court in Corner Brook Tuesday afternoon via video conference. His lawyer Courtney Mills waived his right to a preliminary inquiry and elected judge alone in Supreme Court.
The 33-year-old has been charged with aggravated assault, assault with a weapon, robbery, and breaking and entering to commit an indictable offence. He also faces two breaches of probation in relation to the alleged home invasion in the early morning hours of March 16. Court documents report a male victim in the home was assaulted with a hammer and disfigured while being robbed of medication. Police said the man was sent to hospital.
Tuesday, Crown attorney Trina Simms also elected to proceed on a single count of a breach of undertaking or recognisance by indictment.
May 6 has been set as the date for the Supreme Court hearing.
White, who remains in custody, interrupted the court proceeding as it was about to conclude to ask if he would appear via video conference or in person. Judge Wayne Gorman told him the Supreme Court would make that decision.
The brothers from Humber Arm South were arrested in relation to this incident March 17.
Shawn White will appear in provincial court April 30. He faces four charges - aggravated assault, robbery, assault with a weapon, and breaking and entering to commit an indictable offence.
