ST. JOHN'S, N.L. — St. John’s-based RJG Construction Ltd. is facing a number of charges under the Occupational Health and Safety Act and Regulations in relation to an accident during wharf construction in October 2017.
The accident resulted in the 34-year-old male worker’s foot being partially amputated.
The company has been charged with nine violations under the act and regulations which relate to its alleged failure to:
- Provide and maintain a safe workplace;
- Provide information, instruction, training and supervision necessary;
- Ensure workers and particularly supervisors are made familiar with the hazards;
- Ensure that safe work procedures are followed;
- Ensure that safe work procedures promote the safe interaction of workers and their work environment;
- Ensure that the use of a mobile crane met the requirements of CSA Z150;
- Ensure the OHS Program included written safe work procedures appropriate to the hazards and work activity;
- Implement its OHS Program; and
- Ensure that material was placed in a secure manner that did not constitute a hazard to a worker.
The first appearance is scheduled for July 16, 2019, at Provincial Court in St. John’s.
At the time of the accident, an official with the St. John's Regional fire department said the man, who was wearing a life jacket, fell about five meters to the water and had to be rescued by co-workers who used a small boat to reach him.
The workers then brought the victim to shore where he was treated by Eastern Health paramedics and taken to hospital with a serious foot injury.
